Who Qualifies for a Visa?

The person can submit their application for a V-1 or V-2 visa at a U.S. consulate abroad or seek their V-1 or V-2 nonimmigrant status within the United States if:

1  The person is legally married to a legal resident of the United States (V-1) or is the unmarried child (under 21) of a legal resident (V-2)

2  The person is the principal beneficiary in a petition of a relative (form I-130) filed by a legal resident spouse before December 21, 2000
3 The person has been waiting for at least 3 years since the petition was received for legal residence because their petition is still pending or has been approved, but there is no immigrant visa availability or There is a pending application to adjust the status or to immigrant visa

 

4 The son of a nonimmigrant with a V-1 or V-2 visa qualifies for a V-3 visa or V-3 status
